Rideshare Insurance Limits Cut: What Rideshare Users Need to Know

California’s recent rideshare insurance reforms, SB 371 and AB 1340, are set to transform the rideshare industry, making services more affordable while maintaining essential legal protections for drivers and passengers. These changes carry significant implications for people who rely on rideshare services for transportation or delivery operations.

SB 371: Reducing Rideshare Insurance Costs

A core objective of SB 371 is to address soaring rideshare insurance costs. Currently, California passengers often pay some of the highest fares in the U.S., with roughly one-third of every fare allocated to mandated insurance, and in major cities like Los Angeles, this can approach 50% of the total fare. The previous law required a $1 million Uninsured/Underinsured Motorist (UM/UIM) policy, which was unique to rideshare drivers and not required for taxis or personal vehicles.

“Curbing these excessive insurance requirements is a game-changer. They artificially inflate fares and limit drivers’ earning potential,” said an Uber spokesperson.

The old insurance requirements also contributed to escalated liability risks. Minor collisions frequently led to costly lawsuits affecting both riders and drivers.

Starting January 1, 2026, UM/UIM coverage will be adjusted to $60,000 per individual and $300,000 per accident, aligning rideshare insurance requirements with other vehicles in California. In addition to maintaining $1 million liability coverage for incidents caused by rideshare operators, the law guarantees occupational accident coverage to support drivers’ medical expenses—critical protection for the independent contractor workforce.

Legal Considerations

  • Liability Exposure: SB 371 clarifies UM/UIM coverage, aligning it with general vehicle requirements and reducing potential litigation risk for rideshare users.

  • Occupational Coverage: The law ensures drivers have access to medical and accident coverage, limiting potential liability for small businesses in the event of driver injuries during work-related trips.

  • Collective Bargaining Effects: AB 1340 introduces potential negotiation of driver compensation, which businesses should monitor, as it could indirectly affect service pricing and availability.

Conclusion

California’s SB 371 and AB 1340 highlight a collaborative effort between lawmakers, industry stakeholders, and labor organizations to balance affordability, driver protections, and legal liability. By adjusting rideshare insurance requirements and empowering drivers to organize, these reforms set a precedent that could influence nationwide rideshare regulations, offering opportunities and considerations for small businesses across the state.
