Uber Denies Fault In Fatal Accident – Background of the Case

Uber denies fault in wrongful death lawsuit surrounding the death of 6-year-old Sofia Liu has drawn national attention to rideshare liability laws and the legal classification of Uber drivers.

On New Year’s Eve in San Francisco, Sofia was tragically struck and killed by Syed Muzaffar, an UberX driver, while crossing Polk Street with her mother and brother. The family was in a marked crosswalk near the Civic Center when Muzaffar’s Honda SUV failed to yield.
Sofia’s mother and brother suffered serious injuries but survived. Muzaffar was arrested for vehicular manslaughter with gross negligence and failure to yield to pedestrians, though no charges have yet been filed.


Plaintiffs’ Allegations: Uber’s Role in the Fatal Collision

The Liu family filed a wrongful death and personal injury lawsuit in San Francisco Superior Court, naming both Uber Technologies Inc. and driver Syed Muzaffar as defendants.
Their claim argues that Muzaffar was logged into the Uber app and actively waiting for ride requests when he struck the victims, meaning he was working for Uber at the time.
The plaintiffs assert that Uber should be held vicariously liable for the actions of drivers using its platform during ride-related activities, even if no passenger is in the vehicle.


Uber’s Legal Defense: Independent Contractor Status

Uber’s attorneys filed a response denying all liability, emphasizing that Muzaffar was an independent contractor, not an employee, agent, or partner.
According to Uber’s filing, Muzaffar was not transporting passengers, driving to pick up a fare, or responding to a ride request when the accident occurred. The company argued that the driver had no operational reason to be interacting with the Uber app.
Attorneys further described the driver’s phone screen as displaying only a GPS map, not any fare-related activity — a distinction central to Uber’s independent contractor defense.


Corporate Liability and the Uber Business Model

Uber’s legal team reiterated that the company is a technology platform, not a transportation provider. They maintain that Uber’s core business is to connect riders and drivers through a digital app, meaning it should not be held responsible for a driver’s actions outside of an active trip. Uber denies fault. 
Although Muzaffar had passed a background check, Uber’s lawyers argued that the company’s responsibilities end once drivers are not engaged in active fares. This position highlights the ongoing legal gray area around rideshare driver classification and employer liability.


Regulatory Context: California’s Rideshare Insurance Requirements

The case also exposes gaps in California rideshare laws. The California Public Utilities Commission (CPUC) recently implemented a rule requiring rideshare companies like Uber and Lyft to carry at least $1 million in commercial liability coverage per incident.
However, experts note a major insurance coverage gap: the law mandates coverage when a driver is carrying passengers or en route to pick one up, but it remains unclear whether logged-in drivers waiting for requests are covered. This ambiguity is now central to the Uber accident lawsuit filed by the Liu family and why Uber denies fault.

The Sofia Liu case highlights a critical question for the gig economy: When does corporate liability begin and end for rideshare companies like Uber?
