Modesto Rideshare Accident Attorneys
Modesto Uber & Lyft Accident Lawyer
Modesto rideshare trips run on surface streets more than most. One freeway crosses the city; the other two state routes through it are ordinary roads with traffic lights.
What you can claim depends on where you were sitting. Passenger, rideshare driver and third party are three separate coverage positions, and the driver’s app status at impact decides which insurer answers.

Can I Make a Claim After an Uber or Lyft Accident in Modesto?
Possibly. It turns on fault, which of the three claimant positions you were in, what the driver’s app was doing, and what the injuries turn out to need.
App status settles first. Uber and Lyft hold trip records that answer it, and the answer moves a claim between two very different insurance frameworks.
Then where it happened. Modesto police cover the city’s streets, and because two of the three state routes through town are surface roads rather than freeways, more of a Modesto trip sits under city jurisdiction than the route numbers suggest.
Which Situation Describes You?
Uber & Lyft Accidents in Modesto
Modesto is easy to misread on a map. SR-99 is the only freeway through the city. The other two state routes are ordinary streets: 132 runs along Ninth and Yosemite, and 108 goes up McHenry and through the one-way K and L pair downtown. A driver following a route number here is often just driving a city street with traffic lights on it.
I-5 does not come near. It sits roughly seventeen miles west, so a trip toward the Bay Area begins on surface roads whichever way it goes.
The rail picture catches people out too. ACE does not serve Modesto directly, only a connector bus from the Vintage Faire park-and-ride. The Amtrak platform sits out on Held Drive, about five miles from downtown, so arriving by train and finishing the journey by car is the normal pattern rather than the exception. The city airport has no commercial service at all.
Why the Uber or Lyft Driver's App Status Matters
California sets rideshare insurance requirements by app status, in Public Utilities Code section 5433.
App off
Personal policy
Not working. The driver’s own auto policy is generally the starting framework.
App on, no ride accepted
Reduced commercial cover
Waiting for a request. $50,000 per person, $100,000 per incident, $30,000 property, plus a $200,000 excess layer.
Ride accepted onward
$1 million primary
$1,000,000 combined for injury, death and property damage, acceptance to drop-off.
Two points often missed. The $1 million attaches on acceptance, not at pickup. The uninsured motorist cover beside it, $60,000 per person and $300,000 per incident, runs only while a passenger is aboard.
A limit caps what one policy pays, not what a claim is worth. Learn how California rideshare insurance works →
Who Can Be Responsible for a Modesto Rideshare Accident?
Not every party below matters. The evidence decides.
The Uber or Lyft driver
Their conduct, and what the app was doing.
Another motorist
Frequently the party actually at fault.
The vehicle owner
Not always the person driving.
An employer or business
Where another driver involved was working.
A vehicle or component manufacturer
Where the facts support a defect.
A public entity
Where the roadway facts support it, on a shorter deadline.
Another responsible person or entity
A contractor, an owner, or whoever the evidence reaches.
Uber and Lyft are not automatically answerable for a driver’s negligence, though their cover may respond.
What Compensation May Be Available?
- Medical expenses
- Future medical care
- Lost income
- Reduced earning capacity
- Pain and suffering
- Property damage
- Other supported losses
Value follows proof: the injury, the treatment, the care ahead and the earnings lost.

2 years*

Modesto Rideshare Accident FAQs
What insurance applies after an Uber or Lyft accident in Modesto?
It depends what the app was doing. App off, the personal policy is generally the framework. App on and waiting, a reduced level of commercial cover applies. From acceptance to drop-off, a $1,000,000 primary framework can apply.
What if I was an Uber or Lyft passenger?
You hold the strongest of the three positions, because the trip was live. Fault still has to be established, and another motorist’s policy may also apply.
What if I was driving for Uber or Lyft?
You were working, and the app decides what is open to you. Waiting for a request is a different insurance period from carrying a passenger.
What if an Uber or Lyft driver hit my vehicle?
App status is the whole coverage question. The higher band attaches on acceptance, so a driver running empty toward a pickup is already inside it.
What if my crash happened on a trip between Modesto and another Central Valley city?
The law does not change at a city line. What changes is which agency wrote the report, and on SR-99 that is the Highway Patrol rather than a city department.
