Court Rules Against Uber Lawsuit in Rideshare Accident

A New Jersey appeals court has ruled that a couple injured in an Uber crash cannot file an Uber lawsuit against the company for damages, citing Uber’s terms and conditions requiring disputes to be handled through binding arbitration instead of a court of law.

The couple, both in their 50s, filed an Uber lawsuit seeking compensation for severe physical and psychological injuries after their Uber vehicle ran a red light and collided with another car in early 2022. Despite their argument that their minor daughter had accepted Uber’s user agreement on their behalf while ordering food through Uber Eats, the appellate court upheld Uber’s position — enforcing its arbitration clause.


How Uber’s Terms and Conditions Impact Legal Rights

Like many major tech companies, Uber’s user agreement includes a mandatory arbitration provision. This clause prevents users from filing lawsuits in court and instead requires them to resolve disputes privately before an arbitrator.

The court found that the arbitration clause in Uber’s terms was valid and enforceable, whether the user herself or a family member using her account had clicked “accept.” The judges wrote that Uber passengers are bound by those terms whenever they use the app, even for related services like Uber Eats.

This decision highlights an important issue for consumers: by using Uber, riders may be unknowingly waiving their right to sue the company in civil court if they’re injured in an accident.


The Accident: A Life-Altering Uber Crash

In March 2022, the couple was riding in the back seat of an Uber when the driver allegedly ran a red light and T-boned another vehicle. Both passengers suffered serious injuries:

  • John sustained a fractured sternum and arm, requiring bone graft surgery.

  • Georgia suffered multiple spinal, rib, and abdominal injuries, requiring extensive surgeries and over a year of recovery.

Medical expenses and lost wages quickly mounted, and their insurance didn’t cover injuries sustained while riding in a commercial vehicle. When the couple turned to Uber for compensation, they learned the hard way that the terms of use limited their ability to sue in open court.


Why Arbitration Can Limit Uber Accident Victims’ Options

The couple’s case underscores how Uber’s arbitration clause can impact accident victims. Arbitration is a private dispute resolution process that tends to favor corporations by limiting transparency and keeping proceedings out of the public eye.

Under Uber’s agreement, passengers may be required to settle even personal injury or wrongful death claims through arbitration rather than pursuing a lawsuit. The appellate court ruled that Uber’s language clearly indicated users must resolve disputes “not in a court of law.”

Critics argue that these clauses are overly broad and prevent victims from obtaining fair compensation for medical bills, lost income, and emotional suffering.
